Privacy Policy for AyuTalk
Think GoRapid Technologies Pvt. Ltd. (“Company” or “AyuTalk” or “We” or “Our” or “Us”) respects an individual's privacy and is committed to protecting the same. This Privacy Policy (“Policy”) describes how we collect, use, disclose and transfer Personal Information (as defined below), through website as well as other software and applications including but not limited to mobile applications provided by AyuTalk under the domain, i.e. https://ayutalk.com of our Users (hereinafter, collectively referred to as “Customer” or “User” or “You” or “Your”) and ensure its compliance with applicable laws and regulations. Please refer to AyuTalk’s “Terms of Service”, incorporated by reference herein also.
01 WHY THIS PRIVACY POLICY?
This Privacy Policy is published in compliance with, inter alia: i. Section 43A of the Information Technology Act, 2000:
This Privacy Policy states the following:
- 1. Regulation 4 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (the “SPI Rules”); and
- 2. Regulation 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011.
- 1. The type of information collected from the Users, including sensitive personal data or information;
- 2. The purpose, means and modes of usage of such information; and
- 3. How and to whom we will disclose such information.
02 WHAT PERSONAL INFORMATION DO WE COLLECT?
We collect Information through our Website to provide better services and results to our Users. Information is collected by the details provided by User and the data collected by the usage of the services. In general, the user can browse the Website without revealing any Personal Information. Although once Personal Information is provided, the identity of the User is not anonymous anymore. Where possible, we indicate which fields are required and which fields are optional. Our User always has the option of not providing Information by choosing not to use a particular service or feature.
Other Information collected includes device information i.e. from which device are the services being used. This shall include the hardware model, operating system, unique identification number associated with the device etc.
Generally some of the Services require us to know who you are so that we can best meet your needs. When you access the Services, we may ask you to voluntarily provide us with certain information that personally identifies you or could be used to personally identify you. Without prejudice to the generality of the above, information collected by us from you may include (but is not limited to) the following:
The information collected from you by AyuTalk may constitute 'personal information' or 'sensitive personal data or information' under the SPI Rules. Personal information is defined under the SPI Rules to mean any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available with a body corporate, is capable of identifying such a person.
The SPI Rules further define “sensitive personal data or information” of a person to mean personal information about that person relating to:
Information that is freely available in the public domain or accessible under the Right to Information Act, 2005 or any other law will not be regarded as personal information or sensitive personal data or information.

- 2. Demographic data (such as your gender, your date of birth and your pin code);
- 3. Data regarding your usage of the services and history of the appointments and other transactions made by or with you through the use of Services;
- 4. Health or medical data (such as your past medical history and conditions, diagnostic reports, prescriptions and medication history)

- 6. Other information that you voluntarily choose to provide to us (such as information shared by you with us through emails or letters, your work details, your family details)

03 PURPOSE FOR WHICH THE PERSONAL INFORMATION IS COLLECTED

We may also collect and/or generate anonymized and aggregated information from your use of the Platform. The anonymized and aggregated information is used for a variety of functions, including to help us identify and remediate any bugs, and to improve the performance of our Platform. We may share this information with third parties for our or their purposes in an anonymized or aggregated form that is designed to prevent anyone from identifying you.
We maintain a social media presence, such as a Facebook, Instagram, LinkedIn and a Twitter feed. When you interact with us using social media, we may receive information such as your user ID, your profile picture, photos you post, and similar information. Your use of social media sites is primarily governed by the site operators' privacy policies.
Payment Information: You may provide payment information when you use the Platform to buy our Products. The payment information is provided directly by you, via the Platform, into the PCI/DSS-compliant payment processing service to which the Company subscribes, and the Company does not, itself, process or store the payment information, except as stated herein.
In case of our customer care support, we may record calls for quality and training purposes.
- verify your identity; fulfill the Product/Service purchases and transactions; communicate with you about your account.
- booking and confirming the teleconsultation appointments.
- comply with our legal obligations, policies and procedures, including compliance with relevant industry standards.
- prevent, detect, investigate and take action against crimes (including but not limited to fraud and other financial crimes).
- Performance of a Contract: some of the Personal Information processed is performed on the basis that it is necessary for the performance of our agreement with you.
- Legitimate Interest: legitimate interests will include where we send you marketing information about our Products.
- Compliance with a Legal Obligation: necessary in order to allow us to comply with a legal obligation (e.g., retaining business records).

04 HOW DO WE COLLECT YOUR PERSONAL INFORMATION?
We communicate with you through a variety of means and channels, including our Platform, email, phone or text messaging on your mobile phone, although we do generally note that our preferred means of communication is email which has the least impact on the environment. We collect and receive the Personal Information in the following ways:
- When you submit your Personal Information on our Platform: Including voluntary registration, placing orders, booking appointments, or responding to surveys.
- Automatic collection: Including information about your use of the Platform, interaction with content, and metadata collected via cookies, Internet tags, and web beacons.
- Other sources: Including updated delivery and address information from third parties, or information from third-party application or social media sites through which you allow us to collect data.
05 RETENTION OF PERSONAL INFORMATION
We will retain your Personal Information only as long as it is reasonably required or otherwise permitted or required by applicable laws or regulatory requirements.
We also maintain appropriate and adequate administrative, technical and physical safeguards designed to protect your Personal Information against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use.
06 OPTING OUT / WITHDRAWAL OF CONSENT
The Platform provides an option to all the Customers to opt-out of receiving any promotional or marketing communications from us. You have the right to withdraw this consent at any time by writing to us at info@ayutalk.com.
Updating your Personal Information in relation to your account: You can update or correct your name, and other details by logging into your account and clicking on the "My Profile" page.
Remove content from Customer review: You can remove content that you posted on a public space by e-mailing details to info@ayutalk.com.
07 HOW WE STORE YOUR PERSONAL INFORMATION?
We may store Personal Information using our own secure on-site servers or other internally hosted technology. Your Personal Information may also be stored by third parties, via cloud services or other technology, with whom AyuTalk has contracted. These third parties do not use or have access to your Personal Information other than for cloud storage and retrieval.
08 CONFIDENTIALITY AND SECURITY
Disclosure may be necessary to provide Users access to our Services, to comply with our legal obligations, or to respond to subpoenas and court orders. We may share your personal information with another business entity should we plan to merge with or be acquired by that entity.
In order to secure information, we review the processing and storage practices to guard against unauthorized access. We subject our Employees and Agents to strict confidentiality agreements.
We use various methods to safeguard Personal Information:
- Physical measures: locked filing cabinets, restriction of access to offices, and alarm systems.
- Technical tools: passwords and encryption, using generally industry best practices.
- Organizational controls: confidentiality agreements, limiting access on a need-to-know basis.
10 THIRD PARTY ANALYTICS
We use third-party analytics services like Google AdSense. Google’s use of the DART cookie enables it to serve ads to our Users based on previous visits. Users may opt-out by visiting the Google Ad and Content Network privacy policy.

11 CHILDREN AND MINOR'S POLICY
The Platform is accessible to users aged 13 and above. Users under 18 must obtain parental or guardian consent.
Data collected from users aged 13-17 will not be used for targeted advertising or profiling. Sensitive data (location, biometric, financial) will not be collected from this age group without explicit parental consent.
It is advised that the parents and guardians supervise the online activities of their minor children and consider using parental control tools.
12 DISPOSAL AND POLICY REVIEW
Disposal: We shall take reasonable steps to delete or permanently de-identify Personal Information that is no longer needed.
Policy Review: We review and may make changes to this Policy. When changes are made, the Policy link will include a notation “Revised (date).”

By using our platform, you consent to our collection and use of information. You agree to receive all communications even if your mobile number is registered under DND/NCPR list under TRAI Regulations.
You confirm that no communication shall be construed as Unsolicited Commercial Communication under Regulation 2(bw) of the TRAI Regulations.
